TERMS AND CONDITIONS OF COMMISSIONING AND REPRODUCTION OF PICTURES
All assignments are covered by these Terms & Conditions unless otherwise agreed and signed for in writing.
Once the Client has made a booking for a specific time and date, in writing or verbally Eye Imagery will not accept any other work from other clients for those times and dates. As a result, if the booking is subsequently cancelled we will charge 50% of the quoted rate. If an assignment is cancelled within 48 hours of the start time, the total fee will be payable.
If Eye Imagery require a Purchase Order number for invoicing, this should be provided at the time of confirmation of the assignment.
All invoices are payable 28 days from invoice date.
If any invoice issued to the Client is not paid by the due date, then all unpaid invoices issued to the Client become due of immediate effect, even if it is less than 28 days from the issue date, and that Eye Imagery may consider these invoices as overdue when pursuing legal action for the recovery of said debts.
A fee of £25.00 (excluding VAT) will be made for each account reminder, duplicate invoice, or any other paperwork, correspondence or phone calls involved with the pursuit of a debt. This fee is non-refundable, and represents the additional time spent pursuing overdue invoices.
We do not relinquish copyright. Contact us with your requirements and reasons for requiring copyright and we will try to help.
On full payment of the invoice, clients are granted a licence to use final images for unlimited editorial or advertising usage worldwide.
We reserve the right to use any photograph on our website or to promote our work in other marketing material. Commissioned images and embedded data will not be made available to third parties without the express permission of the client. Commissioned images will not be sold to third parties. Eye Imagery reserves the right to refuse to supply or grant a reproduction license to a third party when requested to do so by the Client.
Eye Imagery’s preferred delivery method for photographs is via a gallery system. This system provides secure storage for images in several different sizes for web up to large high resolution print. For shoots that only produce a small number of images email will be used. Images and videos will be left on the gallery system as long as the client continues to use Eye Imagery. We always suggest images are downloaded to your own secure servers when possible.
Eye Imagery reserves the right to suspend ongoing services.
Eye Imagery will edit every take and deliver what we consider to be the
best of every situation covered.
No addition to, deletion from or alteration to or adaptation of a picture may be made without the permission of Eye Imagery. This sort of digital manipulation is only permitted when carried out by Eye Imagery.
Unless a rejection fee has been agreed in advance, there is no right to reject on the basis of style, composition or editing.
The Client is responsible for providing a full brief of the job with picture requirements. The client is responsible for having an authorised representative at the job site to approve Eye Imagery’s interpretation of the commission. If the Client’s representative is not present then Eye Imagery’s interpretation shall be deemed acceptable.
It is the Client who must satisfy himself that all necessary rights, model releases or consents which may be required for reproduction, are obtained and it is acknowledged that Eye Imagery gives no warranty or undertaking that any such rights, model releases or consents have or will be obtained whether in relation to the use of names, people, trade marks, registered or copyright designs or works of art depicted in any picture. In the event that the picture issued or reproduced by or with the authority of the Client then the Client shall indemnify Eye Imagery against any loss or damage, proceedings or costs where such rights, releases or consents have not been obtained.
All prices are in sterling. VAT will be added at the current rate.
Payment should normally be made by cheque or bank transfer. BACS details can be found on the invoice.
We reserve the right at any time, in our sole discretion, to make any changes to these Terms & Conditions. Any changes will be notified to you by publishing the revised Terms & Conditions on this website. By booking an assignment after such notification you agree to be bound by such changes.
